CBD oil has gained recognition in the cannabis market for its therapeutic advantages and benefits to overall health. Word has been spreading fast, and now more and more States are opening up CBD stores, including the State of Maryland.

Anti-legalization lobbyists of cannabis based their primary criticisms on the psychoactivity of cannabis, and they didn’t see it fit to medicalize a substance most people were utilizing recreationally.

However, CBD isn’t psychoactive, and so when some kids benefited from CBD for epilepsy, CBD was identified, examined, and eventually legitimized as a medical means, which reduces its scrutiny.

A study was released in 2017[1] by the WHO Expert Committee on Drug Dependence, indicating the benefits of CBD in these certain medical conditions: 

CBD hemp oil falls under the 2014 Farm Bill. The Bill allows hemp-derived CBD products, including hemp oil, in all 50 states. However, in-state laws can state otherwise. Yes! CBD oil is fully legal in Maryland as long as the product is derived from hemp with less than 0.3% THC. You are safer than not using and buying CBD or cannabis-derived in Maryland because the laws of the hemp plant and usage for the public are still being written. 

Even so, Maryland is among the slowest states to implement CBD laws in the nation. The United States government allowed states, under the Farm Act in 2014, to cultivate as well as research industrial hemp.

With House Bill 803,[2] Maryland moved swiftly, and in 2015 they launched their initiatives and removed industrial hemp from the cannabis-controlled status. They further allowed the cultivation of industrial hemp throughout Maryland with House Bill 443[3] in 2016.

This means that CBD oil and hemp-derived cannabis extracts from industrial hemp are legal in Maryland, and one can buy or sell without restrictions. However, usage, possession, and sale of medical marijuana-based products and cannabis products are considered a federal violation because it is classified as Schedule I drug under the Controlled Substance Act.

However, the court will protect any individual because the federal government is prohibited from interfering in the implementation of state programs by law. Because THC is the component of cannabis that makes someone high, the state rule requires that industrial hemp have no more than 0.3% THC.

According to House Bill 104,[4] medical marijuana can be used in the state of Maryland but never for recreational purposes. This is because medical marijuana uses a higher dose of THC than CBD oil. After all, it is used to treat debilitating conditions.

Patients qualified for medical marijuana use are allowed to possess up to 120 grams, but they can only use it in a vaporized form, ointments, extracts, tinctures, and lotions. It is considered illegal to smoke it.

The government asked the Maryland Department of Health and Mental Hygiene to develop regulations for the medical marijuana patient registry, together with the Natalie LaPrade Medical Marijuana Commission. This includes developing dispensary licensing, identification cards, possession limits, and setting fees.

However, these health-providing legislations are met with opposition, and consider Maryland the slowest state when it comes to rolling out new regulations in the CBD field. In 2011, Senate Bill 308[5] was approved and removed the penalty for small possessions by recognizing specific medical conditions. However, they didn’t remove the $100 fine.

There continues to be a plethora of counterproductive legislation passed in Maryland, vetoed, and sometimes approved, then rescinded, making the CBD field somewhat of a legal grey area in Maryland.

This continued to be the case in 2013 when House Bill 1101[6] was passed approving medical institutions to conduct research studies in medical cannabis. The Natalie M. LaParade Medical Marijuana Commission and Fund were charged with creating regulations that would develop procedures, policies, and guidelines that would implement the Bill. However, the entire research process throttles because the commission doesn’t have the power to license more than five medical marijuana growers.

Over the years, there have been more cases like this in the state, which leaves Maryland CBD laws in flux. Politics seem to take the central case in most cases rather than doing what will benefit the people more and give them the health benefits of CBD and cannabis-derived products.
